Vessel Speed Ordinance

VESSEL SPEED ORDINANCE

An ordinance to regulate the speed of vessels and to provide for the safe use of the waters in Genoa Township, Livingston County; enacted under the authority of Act 303, P.A. 1967, as amended, M.S.A. 18.1287 (17), being identical to State Administrative Rules filed in the office of the Secretary of State.

THE TOWNSHIP OF GENOA ORDAINS:

SECTION I

All words and phrases used in this ordinance shall be construed and have the same meanings as those words and phrases defined in Act 303, P.A. 1967, as amended, M.S.A. 18.1287 (8).

SECTION II

R 281.747.18. Chilson Creek and Chilson Pond; operation of vessel powered by motor. Ruled 18. On the waters of Chilson Creek and Chilson Pond (impoundment in Brighton Recreation area, section 33, T2N, R5E, Genoa Township and section 4, T1N, R5E, Hamburg Township, Livingston County, it is unlawful to operate a vessel powered by a motor except an electric motor.

SECTION III

All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

SECTION IV

Violations of this ordinance are a misdemeanor and may be punished by a fine not to exceed one hundred dollar ($100) together with costs of prosecution or imprisonment in the county jail or such other place of detention as the court may prescribe, for a period not to exceed ninety (90) days, or said fine, costs of prosecution, and imprisonment, at the discretion of the court.

SECTION V

This ordinance and the various parts, sections, subsections, provisions, sentences and clauses are severable. If any part of this ordinance is found to be unconstitutional or invalid it is declared the remainder of this ordinance shall not be affecter hereby.

SECTION VI

This ordinance shall take effect 30 days after its publication in the Brighton Argus Newspaper.

We, the undersigned Supervisor and Clerk of the Township of Genoa, Livingston County, do hereby certify that the above ordinance was passed by the Genoa Township Board on the 20th day of June, 1977, and that is was published in the Brighton Argus Newspaper on the 29th day of June, 1977.
